HORIZON ONLINE CAMPUS TERMS OF SERVICE
The following terms and conditions (the “Terms”) govern your relationship with Horizon Church and your subscription and access to Horizon Online Campus including any content, functionality and services offered on or through it.
1. BY SUBSCRIBING
Please read the Terms carefully before you subscribe. By subscribing and accessing Horizon Online Campus you accept and agree to be bound by these Terms. If you do not want to agree to these Terms, you must not subscribe to the Campus or use the Website.
As provided below you may cancel your subscription at any time.
2. NOTICE OF CHANGES TO TERMS OF USE
Horizon Church may revise and update these Terms from time to time in its sole discretion. You are expected to check this page from time to time so you are aware of any changes, as they are binding on you.
3.PRIVACY POLICY
Your subscription to and access to Horizon Online Campus are governed by the Horizon Church Privacy Policy, https://hz.church/privacy, which is incorporated herein by reference and on subscription to Horizon Online Campus.
4. SUBSCRIPTION SECURITY
To subscribe to Horizon Online Campus, you will be asked to provide certain personal details or other information. It is a condition of subscription that the information you provide is correct, current and complete. We have the right to disable any user name, password or other identifier at any time.
You acknowledge that your subscription is personal to you and agree not to provide any other person with access to Horizon Online Campus using your subscription information. You agree to notify us immediately of any unauthorised access to or use of your user name or any other breach of security.
5. SITE ACCESS
Horizon Church reserves the right to prohibit any person from subscription or accessing the Horizon Online Campus for any reason whatsoever, at any time without notice.
6. ELECTRONIC COMMUNICATIONS
When you subscribe and access Horizon Online Campus, send emails to Horizon Online, you are communicating with us electronically. You agree that all other communications that are provided to you electronically satisfy any legal requirement that such communications be in writing.
7. COPYRIGHTED MATERIALS
All materials contained on Horizon Online Campus (“Online Material”) are the property of Horizon Church. Horizon Church, its licensors and other providers of Online Material are protected by international copyright, trademark, trade secret and other intellectual property or proprietary rights laws. Unauthorized use of Online Material may violate these laws and other regulations and statutes.
Online Material may not be copied, distributed, displayed, downloaded, or transmitted in any form or by any means without the prior express written permission of Horizon Church or the copyright owner. By way of example only, you must not copy, reproduce, adapt, distribute, or create any derivative works from, any material from Horizon Online Campus, delete or alter any copyright, trademark or other proprietary rights notices, access Horizon Online Campus for any purpose other than personal, non-commercial use. This includes the use or inclusion of Horizon Online Campus content or communications in external media forums, both traditional and social.

8. REPORTING CLAIMS OF COPYRIGHT INFRINGEMENT
Horizon Church takes claims of copyright infringement seriously. We will respond to claims of alleged copyright infringement that comply with applicable law. If you believe any materials accessible on or from Horizon Online Campus infringes your copyright, you may request removal of those materials by submitting written notification to the Horizon Church (att: Copyright ) at the address detailed below.
9. TRADEMARKS
The trademarks, logos and service marks (“Marks”) displayed on Horizon Online Campus are the property of Horizon Church, affiliated Horizon Church entities, or their licensors or content providers. You are not authorized to use our Marks nor use logo(s) as a hyperlink to Horizon Online Campus without the written permission of Horizon Church. Permissions can be requested at Horizon Church (att: Online Campus ) at the address detailed below.
10. REPUBLISHING /TRANSMISSION
The content on Horizon Online Campus may not be copied, reproduced, republished, uploaded, posted, transmitted, distributed, or used in any way unless specifically authorized by Horizon Church. We may disable all or any social media features and any links at any time without notice at our discretion.
If Horizon Online Campus contains links to other sites and resources provided by third parties, these links are provided for your convenience only and are not an endorsement of content, the presenters or owners of these sites and resources. Unless posted by or with the approval of Horizon Church we have no control over the contents of those sites or resources and if you access third party websites linked to Horizon Online Campus, you do so entirely at your own risk and subject to the terms and conditions of use for such websites.
11. INDEMNIFICATION
You agree to defend, indemnify and hold harmless Horizon Church, its affiliates, licensors and service providers, from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms.
12. DISCLAIMER
Horizon Church does not guarantee or warrant that files download from Horizon Online Campus will be free of viruses or other destructive code. You are responsible for implementing procedures to satisfy your requirements for anti-virus protection and maintaining a means external to the Website for reconstruction of any lost data.
Your access to Horizon Online Campus, the content and any services or items obtained is at your own risk.
13. LIMITS OF LIABILITY
Neither Horizon Church, its affiliated entities, nor their licensors, service providers, employees, agents, officers or directors, will be liable for damages of any kind, under any legal theory, arising out of or in connection with your use, or inability to access the campus, any website linked to it, any content on the campus or any services or items obtained through the campus or such other websites, including any direct, indirect, special, incidental, consequential or punitive damages, including but not limited to, personal injury, pain and suffering, emotional distress, loss of revenue, loss of profits, loss of business or anticipated savings, loss of use, loss of goodwill, loss of data, and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable.
The foregoing does not affect any liability which cannot be excluded or limited under applicable law.
14. CANCELLATION OF SUBSCRIPTION
You may at any time cancel your subscription to Horizon Online Campus by written notice to Horizon Church at the contact details provided below.
Upon cancellation of subscription you may also exercise any, or all of, your rights with respect to personal information held by Horizon Conference or any other affiliated Horizon Church entity. Full detail of these rights and the relevant contact details and procedures are contained with the Privacy Policy.
15. GOVERNING LAW AND JURISDICTION
All matters relating to these Terms and any dispute or claim related thereto are governed by and construed in accordance with Australian Law, without giving effect to any choice or conflict of law provision.
Any legal suit, action or proceeding arising out of, or related to, these Terms or Horizon Church shall be instituted exclusively in the federal courts of Australia or the courts of New South Wales.
16. ENTIRE AGREEMENT
These Terms and our Privacy Policy constitute the sole and entire agreement between you and Horizon Church with respect to Horizon Online Campus.
17. AGE REQUIREMENT TO SUBSCRIBE
Subscribers to Horizon Online Campus under sixteen (16 ) years of age must have a parent or legal guardian agree to these Terms prior to access. If you do not meet these requirements, you must not subscribe or access Horizon Online Campus.
18. GEOGRAPHICAL RESTRICTIONS
Horizon Church makes no representation that content or materials in Horizon Online Campus are appropriate or available for use in all geographical locations.
If you choose to access Horizon Online Campus you do so at your own risk. You are always responsible for your compliance with applicable laws in the country in which you reside.
19. WAIVER AND SEVERABILITY
No failure of Horizon Church to assert a right or provision under these Terms shall constitute a waiver of such right or provision.
If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be removed or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.
